Woman wins settlement after suffering brain injury from poorly drained road

A case has been settled in the High Court of Ireland which determined that a woman suffered a traumatic brain injury after her car aquaplaned on a road that had insufficient drainage. 

Tara Mulrooney, 45, suffered a traumatic brain injury in July 2012 when her car spun out of control and hit a tree on Tipperary road, Tipperary, Ireland. Mulrooney was in hospital for five months following the incident, now living with cognitive deficits and balance problems.

Mulrooney claimed against South Tipperary County Council, now Tipperary County Council, settling the High Court case last week.

According to reports, the court was told there was a downpour of rain earlier that night and that South Tipperary council failed to lay rough chip asphalt, that there was a failure to elevate the road, and that there was a lack of adequate drainage, leading to water pooling on the road.

Ms Justice Reynolds said Mulrooney were not be alive if the gardai had not contained the fire that broke out in the car.

South Tipperary County Council had denied the claims and alleged that Mulrooney was driving with worn down, underinflated tyres and failed to drive according to conditions.
